Church of Scotland Moderator joins Twitter

(John Young)

The Moderator of the General Assembly of the Church of Scotland, the Right Reverend Lorna Hood

The Moderator of the General Assembly of the Church of Scotland has embraced mass communication in the 21st century by joining Twitter.

The Right Reverend Lorna Hood once claimed she was "the loneliest person on the internet" with only one Facebook friend but she's hoping for a few more followers than that on Twitter.

Despite some reservations, Mrs Hood has said she is looking forward to engaging with other Twitter users and has set herself the modest goal of attracting 500 followers by Christmas.

She got the ball rolling with her first tweet on Tuesday in which she joked that she "had to give in to Comms team".

"Looking for the Idiots' Guide," she said.

After just a day on the social media network, she is well on the way to her goal of 500 followers, with just under 200 following her so far.

Mrs Hood said she joined the website in a bid to reach out to churchgoers across the globe and to further involve the Kirk with the changes taking place in the digital age.

She said: "Jesus has many followers. I'd be happy with four or five hundred followers by Christmas. I'm looking forward to tweeting and talking with everyone who uses Twitter."

Lawson, Saatchi are granted preliminary divorce

LONDON (AP) ? Celebrity chef Nigella Lawson and art baron Charles Saatchi have taken the first legal step toward finalizing the end of their marriage.

In a hearing at London's High Court lasting less than a minute, District Judge Anne Aitken granted the couple a decree nisi ? the first of two stages of divorce.

The divorce of 70-year-old Saatchi and 53-year-old Lawson can become final after six weeks and a day, with the granting of a decree absolute.

The couple separated after a newspaper published photos last month of Saatchi grasping his wife's throat during an argument at a London restaurant.

A Moderate Verdict

Bradley Manning Verdict Pvt. Bradley Manning is escorted by military police after he was found not guilty of aiding the enemy

Reporters and leakers all over Washington, D.C., are heaving a sigh of relief: On Tuesday, a military judge found Pvt. Bradley Manning not guilty of ?aiding the enemy.?

Manning, whose sentencing begins tomorrow, will probably still be spending at least a couple of decades in prison for 19 other crimes, but his conviction on most of those charges had been expected; he?d already pled guilty to some of them. But ?aiding the enemy? was the most serious accusation. It?s labeled a capital crime; although prosecutors were not seeking the death penalty in this instance. He would have been put behind bars for life. More broadly, a guilty verdict on the charge of aiding the enemy would have turned the climate for investigative journalism?already as tense as it has been for many years?into a toxic dust cloud.

Prosecutors had argued during the trial that the documents Manning supplied in 2010 to WikiLeaks?which, in turn, provided them to the New York Times and other publications?were read by Osama Bin Laden, who took comfort from them. Therefore, they contended, Manning had aided the enemy.

It was an explosive argument. Few officers or enlisted personnel had ever been tried for ?aiding the enemy??codified at Article 104 of the Uniform Code of Military Justice?and none had been convicted on that charge merely for leaking classified documents to a news agency (or, in WikiLeaks? unusual case, an intermediary to news agencies).

Had the judge accepted the argument and found Manning guilty of the broad new charge, the implications would have been profound. By such a verdict?s logic, The New Yorker could have been accused of aiding the enemy for publishing Seymour Hersh?s article about the torture of detainees at Abu Ghraib. Hersh?s intention may have been to call attention to war crimes being committed by U.S. officers in Iraq, but a prosecutor could certainly have argued that the story served al-Qaida?s interests; and it?s certainly true that the revelations over Abu Ghraib were used as recruitment tools by jihadists worldwide.

In fact, by this logic, any published criticism of an American war, or of U.S. foreign policy generally, could be interpreted as ?aiding the enemy? if copies were found in enemy hands. For that matter, news reports of Southern racism in the 1950s could have been prosecuted on those grounds because the Soviet Union?the enemy in the era?s Cold War?cited those reports in its anti-American propaganda campaigns, especially in the developing world.

True, Manning was tried in a military court by military prosecutors and a military judge. A newspaper or magazine, in these hypothetical scenarios, would be tried in a federal court by Justice Department prosecutors and a civilian judge. The standards are different. Precedents from military trials are rarely cited?and have no legal standing?in civilian courts.

Still, judges and prosecutors are free to cite legal arguments from any type of court they wish. Steven Aftergood of the Secrecy News website notes that, in the indictment against Stephen Kim?the State Department official who recently leaked information about North Korean nuclear testing to a FoxNews reporter?the Justice Department prosecutors cite an argument used by Chief Judge Denise R. Lind; the military judge in the Manning case. Specifically, they quote Col. Lind as saying (on Pages 59?60) that the accused ?had reason to believe the information he communicated could be used to the injury of the United States or to the advantage of any foreign nation.? They add that Lind said the actual damage done by the leak is irrelevant to the fact that he had ?reason to believe? the information ?could be used? to ill effect.

In the Manning verdict today, Judge Lind herself didn?t buy that argument. We don?t yet know why. Was it because she thought the prosecutors hadn?t made their case that Manning knew, or had reason to believe, that Osama Bin Laden would read the news reports based on his leaks? Or did she think the argument was absurdly broad on the face of it?

A federal judge in Virginia came to that latter conclusion in the 2006 case, United States of America vs. Lawrence Franklin, et al., in which a Pentagon official (Franklin) was indicted for leaking classified information to two executives of the American-Israel Public Affairs Committee?and, more alarmingly, the two AIPAC executives were indicted for receiving that information, a crime under the rarely invoked Espionage Act of 1917.

Initially, the presiding judge, T.S. Ellis, allowed the charge to stand, noting that the law ?applies to academics, lawyers, journalists, professors, whatever.? He added that if there?s a problem with that, the law should be changed; but judges can only interpret and apply the law, not nullify it. In the end, though, Ellis went against his earlier pronouncement and dismissed the indictment against the AIPAC analysts, on the grounds that the statute was too vague, broad, inconsistently applied, and draconian. (Franklin, the Pentagon official, was convicted, however for violating his security oath.)

There is another possible reason for Manning?s acquittal on the charge of aiding the enemy: It?s possible the judge simply thought he wasn?t guilty. The charge was always a bit of a stretch for the prosecutors. Article 104 of the UCMJ states that the crime applies to any person who

?(1) aids, or attempts to aid, the enemy with arms, ammunition, supplies, money, or other things; or (2) without proper authority, knowingly harbors or protects or gives intelligence to or communicates or corresponds with or holds any intercourse with the enemy, either directly or indirectly. (Italics added.)?

For the judge to find Manning guilty under Article 104, she would have had to conclude that ?other things? includes classified documents, and that giving intelligence to the enemy ?indirectly? includes giving it to WikiLeaks, which gives it to a newspaper, which is read by the enemy. Such stretches wouldn?t have been unprecedented, in civilian or military courts, but, again, Judge Lind chose not to go there.

It may be that the prosecutor overreached. In his summary remarks, he lambasted Pvt. Manning as not only a leaker, a thief, a security threat, and all the rest, but also a ?traitor.? Whatever one thinks of Manning and his motives, this went too far. Article 3 of the U.S. Constitution states: ?Treason against the United States shall consist only in levying war against them, or in adhering to their Enemies, giving them Aid and Comfort.? (Italics added.) One could make a stretch and claim that Manning?s actions gave aid and comfort to some enemies; but there?s no way that he could be seen as ?adhering? to enemies or as ?levying war? (which later Supreme Court decisions have interpreted to mean physically waging war against the United States).

Whether what Manning did was right or wrong in the broader book of morality, it did violate military law. He knew that; and, in his plea, he accepted responsibility for it, accepted his fate, but always insisted that he had no intention to aid the enemy. The military court?s assent on that point was wise, beneficial for free speech, and for the country.

THE BARGAIN DOLL: Eat Healthy, Drink Healthy!

For someone who is on a #ProjectSexy mode like me, the biggest challenge in my fit lifestyle is food. Working out is not enough to achieve that perfecty toned body, but diet should come hand in hand as well. However, one of the biggest challenge for me is where to find that healthy food when I'm not at home. Where to eat? What to eat?

?Since I'm always on-the-go (and a gym rat too), I'm happy to share to you some of the basic health tricks that are fitting for our lifestyle!

1. NEVER GO FOR THE NO CARBS DIET! Common misconception: ?carbs and fats are enemies?. A proper diet is synonymous to a balanced diet. Meaning, you do not have to eliminate an entire food group, as the trick lies solely on watching your consumption. Carbs and fats aid the body in producing the energy needed in everyday work. So when you?re out, just go for low-fat alternatives; then for carbs, as they say, the darker the shade, the healthier.

2. NO CHIPS FOR SNACKS!?Snacks are crucial in keeping the body?s blood sugar level up. Apart from giving energy, they can also curb hunger pains. Even if it?s too tempting to grab a bar of chocolate or a cheeseburger, you might as well shift your mental image of?merienda?into the likes of yogurt, fruits, or low-calorie energy bars.?

3.NO MORE HIGH CALORIE DRINKS!. Reduce drinking beverages filled with calories that do not nourish the body. Coconut water has been the go-to drink of health enthusiasts primarily because of its natural hydrating properties and ability to flush out toxins. Plus, it has seven times more Potassium content than one banana. (OMG NO MORE MILK TEA & FRAPS FOR MEE)

Good thing there's a drink that?totes all the goodness of refreshment, nutrition, anti-oxidants, and potassium every day in just one drink. Tropicana Coco Quench?has made it easy to bring the natural freshness of real coconut water in a convenient Tetra Pak packaging, with up to 8-month shelf life. It comes in an on-the-go 330ml pack that you can just stash in your bag for a full day ahead.

Hope you enjoyed this little fitness trick! :)

Much Love,

The Bargain Doll

France wants mandate for EU-US trade talks published

PARIS (Reuters) - France called on Monday for the European Commission to make public its mandate to negotiate EU-U.S. free-trade talks, citing what it said was an atmosphere of mistrust over efforts to forge a landmark pact.

The U.S. and EU launched the negotiations earlier this month despite European concerns about U.S. spying that had threatened to delay the start after nearly two years of preparation. France moreover only agreed to the talks after securing assurances that its entertainment industry would be ringfenced.

"The first week of discussions on a transatlantic partnership agreement closed in a climate of doubt," Trade Minister Nicole Bricq wrote in French newspaper Liberation.

"The U.S. once again showed its splendid ambivalence. It is a country where everything seems possible and whose dynamism and energy we French envy. At the same time it is a prickly power incapable of resisting the temptations its supremacy gives it."

Stressing the need for transparency in the talks, Bricq said she had asked EU Trade Commissioner Karel De Gucht to break with usual procedure and make the EU's negotiation mandate public.

"It doesn't contain any secrets. It's a political statement that calls for an agreement that respects our values and interests. It deserves to be debated," she said.

The Commission's mandates to negotiate international trade deals are not made public because it could weaken the EU's hand by revealing its limits to Washington and U.S. lobbies. That said, unofficial leaks of the mandate are common.

"If the talks with United States are for a partnership, and if we are working as equals, then our practices need to change so that we speak the same language," she said.

Bricq also said the Commission should regularly inform the European Parliament of the progress of the talks. At present, the Commission must do so at the end of each round.

The first round of talks, which took place in Washington from July 8 to July 12, mainly set the stage for more substantive negotiations in the weeks and months ahead as the two sides strive to reach a deal by late 2014.

(AP) ? Derek Jeter returned to the New York Yankees' lineup ? again ? with customary flair, making an immediate impact on a team desperate for power.

Jeter homered on the first pitch he saw from Tampa Bay's Matt Moore, connecting Sunday soon after being activated from the disabled list for the second time this month.

"Hopefully I can help in any way, but we need contributions from a lot of people," said Jeter, who made his season debut at shortstop. "It's not like I'm some savior coming in here all of a sudden we're just going to start winning."

The captain's drive ended the Yankees' nine-game homerless drought. It was New York's first long ball by a right-hander since June 25.

Jeter received a loud ovation and came out for a very quick curtain call, waving his cap from the next-to-top step of the Yankees dugout.

To make room for Jeter, the Yankees placed designated hitter Travis Hafner on the disabled list with a right rotator cuff strain. Hafner has slumped to a .205 average. He hit the last of his 12 homers on June 25, a span of 67 at-bats.

Jeter, a 13-time All-Star, had his much-anticipated return July 11 ? as the designated hitter ? after missing the Yankees' first 91 games because of a twice broken ankle. He was first injured during the opener of the AL championship series in October.

But he sustained a Grade 1 strained of his right quadriceps running out a groundball against Kansas City and went right back on the DL.

Fourth in the AL East, the Yankees have gone 4-8 during his second absence and are 54-50. New York has scored fewer runs than all but three teams in the American League this season.

Manager Joe Girardi hopes he'll be penciling the Yankees' career hits leader in the batting order nearly every day from now on.

"It changes our lineup. There's no doubt about that," he said. "And just his presence is important to this club. It's been important for such a long time."

A favorable schedule should help keep Jeter playing every day at the start. The Yankees have off-days Monday and Thursday next week, then only play six games before their next open day.

Girardi said he's been preaching a cautious approach for Jeter when he runs the bases, at least in the first few games of his comeback, to protect the leg. But the always-all-out Jeter had difficulty embracing the concept while dressing in the Yankees clubhouse before Sunday's game.

"I'll try it," Jeter said. "It's kind of hard because I've never really done it. It's not like I'm going to be jogging to first base. I can't do it. I don't think I can do that. We'll see, I'll try."

A career .313 hitter, Jeter was eligible to come off the disabled list Saturday but the Yankees instead had him participate in a simulated game that was shrouded in secrecy. The location of the workout was not disclosed until after the Yankees' 1-0 loss to the Rays.

"I don't know, it wasn't my idea. They needed to see some things," Jeter said. "Evidently they saw what they needed to see."

NOTES: RHP David Phelps (forearm strain) said he will make his second rehab start Tuesday, for Double-A Trenton. ... Injured INF 3B Jayson Nix (strained right hamstring) should be activated when the Yankees visit the Dodgers on Tuesday.
